The Health and Social Care Act 2008 comes into force on 1st October 2010, and from that date all English Care Providers must comply by The Health and Social Care Act 2008 (Regulated Activities) Regulations 2010 and the Care Quality Commission (Registration) Regulations 2009.
CQC Registration & Admission Criteria:
All existing English Care Provider registrations under the Care Standards Act 2000 will cease to have effect by 1st October 2010, by which date they must have registered under the new Act, or, as CQC point out explicitly in their letters inviting registration, the Provider will be committing a criminal offence.
In order to register, the Care Provider must complete a declaration as to whether their service meets the 16 CQC Outcomes of the Essential standards of quality and safety which are required by the new Regulations.

CQC Outcome Implications:
If the Provider is not able to declare that they meet any one or more of the standards, they must state specifically why they do not in each case, and offer a SMART action plan to remedy the non-compliance.
The Provider must understand the new requirements in order to understand whether they meet the standards, and offer an action plan if they do not .
