Health and Social Care Act 2008
The Health and Social Care Act 2008 brought into being the Care Quality Commission, which on 1st April 2009 took over the functions of the Commission for Social Care Inspection (CSCI), the Healthcare Commission (HC), and the Mental Health Act Commission (MHAC). The Act is concerned with registration and inspection of quality, and quality development, of care and health services in England.
The Health and Social Care Act 2008 is enabling legislation, and the details of registration and regulation is provided by a Statutory Instrument, the conditions for registration and the standards under which services are regulated may be changed at any time by the Secretary of State, without further reference to Parliamentary debate.
As of July 2010, the main Statutory Instruments which set out detailed requirements of care providers are:
- The Health and Social Care Act 2008 (Regulated Activities) Regulations 2010
- Care Quality Commission (Registration) Regulations 2009
- The Care Quality Commission (Registration) Amendment Regulations 2010
The Quality Care Systems Ltd care management system has been edited and extended throughout 2010 to bring the contents in line with the new CQC Essential Standards of quality and safety requirements, which all social and health care providers in England were required to meet by 1st October 2010 (with dentists, GPs and other healthcare providers to follow shortly after). This development will continue, and any change to the legislation and Standards introduced in the future will be accommodated by changes to the QCS system.
